Per il Consiglio di Stato deve escludersi che l`articolo 7 della legge n. 241 del 1990, che impone di dare notizia dell`avvio del procedimento ai soggetti interessati, sia applicabile ad una deliberazione di adozione di uno strumento urbanistico generale (o di una sua variante).
L`articolo 13 della legge 241, infatti, esclude espressamente dalla sua operatività gli atti “di pianificazione e di programmazione, per i quali restano ferme le particolari norme che ne regolano la formazione””.
Resta fermo, pertanto, il principio generale in forza del quale la legge speciale prevale su quella a carattere generale.
