Con la sentenza 18 febbraio 2005, n. 51 il TAR Umbria, fissando un importante principio in tema di vincoli archeologici, ha dichiarato l`illegittimità di un provvedimento del Ministero dei beni culturali perchè dalla motivazione non si evince il ritrovamento di reperti sul terreno privato oggetto del vincolo e neppure che vi siano concreti indizi della loro presenza nel sottosuolo.
La fattispecie all`esame del TAR riguarda l`imposizione di un vincolo archeologico su terreni privati circostanti un`area archeologica demaniale. In particolare, il decreto ministeriale ha individuato due tipi zone: la zona A sottoposta a vincolo diretto e la zona B soggetta a vincolo indiretto.
In assenza di reperti o di indizi concreti, pertanto, il fondo del ricorrente non può essere gravato da vincolo diretto ma solo da vincolo indiretto (ai sensi dell`art. 49 D.Lgs. 490/1999 e ora dell`art. 45 e ss. D.Lgs. 42/2004).
