L`ANCE, in un dossier, analizza e riassume le più importanti sentenze della Corte Costituzionale, nel tentativo di definire più compiutamente il riparto delle competenze legislative in materia di governo del territorio e ambiente, dopo la riforma costituzionale del 2001.
La Corte ha fornito un`ampia nozione di governo del territorio, inteso come l`insieme delle norme che consentono di identificare e graduare tutti gli interessi in base ai quali possono essere regolati gli usi ammissibili del territorio.
All`interno del governo del territorio vanno ricondotte l`urbanistica e l`edilizia, materie che rientrano tutte nella sfera della potestà legislativa concorrente, nelle quali le Regioni sono tenute al rispetto dei principi statali, in quanto rappresentano il punto di equilibrio fra esigenze contrapposte.
Principio questo ribadito anche in materia di tutela ambientale, dove spetta allo Stato il potere di fissare standard di tutela uniformi sull`intero territorio nazionale, senza peraltro escludere il ruolo rilevante proprio delle Regioni.
