Con l’allegata nota n. 12695/2013 del 12 luglio u.s., la Direzione Generale per l’Attività Ispettiva del Ministero del Lavoro ha fornito chiarimenti in merito all’applicazione della maxi-sanzione per lavoro “nero” nei confronti dei datori di lavoro che, in alcune giornate di lavoro, non utilizzino i voucher per retribuire il personale impiegato.
Al riguardo, il Dicastero ha chiarito che tale sanzione può essere applicata esclusivamente nell’ipotesi in cui l’utilizzatore non abbia effettuato la comunicazione preventiva all’Inps e all’Inail per l’attivazione delle prestazioni stesse.
Qualora, invece, il datore di lavoro effettui le relative comunicazioni ma utilizzi uno stesso voucher per remunerare più ore o giornate lavorative ovvero ometta di corrispondere per alcune giornate il relativo voucher, non sarà possibile applicare la suddetta maxi sanzione, ma opererà esclusivamente la “trasformazione” in un rapporto di lavoro subordinato a tempo indeterminato, con applicazione delle relative sanzioni civili e amministrative.
