Il Ministero del Lavoro, con l’allegata nota, ha fornito alcuni chiarimenti in merito agli intervalli di tempo tra un contratto a termine e un altro, di cui all’art. 5, co. 3 del D.Lgs. n. 368/2001.
In particolare, è stato chiarito che gli accordi c.d. di “flessibilizzazione”, intervenuti anche eventualmente al livello territoriale e precedenti alle modifiche apportate dal D.L. n. 76/2013, appaiono ad oggi superati.
Come noto, si tratta di accordi volti a ridurre a 20 e 30 giorni i suddetti intervalli di tempo, fissati in 60 e 90 giorni dalla Legge Fornero a seconda che il primo contratto a termine fosse di durata inferiore o superiore a sei mesi e che ora, a seguito del recente intervento normativo, sono stati ridotti “in via ordinaria” in uno spazio temporale tra i due contratti di 10 e 20 giorni.
L’attuale quadro normativo, quindi, supera tali interventi di flessibilizzazione, posti in essere precedentemente e legati a minimi di durata legale per l’interruzione tra un contratto a termine e un altro, in quanto superiori agli attuali periodi normativamente previsti.
