Nella Gazzetta Ufficiale n. 79/16 è stato pubblicato il decreto interministeriale 24 febbraio 2016, che modifica l’art. 2 del dm 4 aprile 2002 per quanto concerne l’indennità di maternità spettante, in caso di adozione e affidamento, alle lavoratrici iscritte alla Gestione Separata.
In particolare, il provvedimento in esame, in vigore dal 20 aprile scorso, dispone che in caso di adozione (nazionale o internazionale) e di affidamento preadottivo di un minore, le lavoratrici iscritte alla gestione separata abbiano diritto all’indennità di maternità per un periodo di cinque mesi (prima tre mesi), secondo le modalità previste dall’art. 26, commi 2, 3 e 5, del d.lgs. n. 151/2001.
Viene quindi eliminato il previgente limite dei 6 anni di età del minore, nei casi di adozioni/affidamenti nazionali, e introdotta, per i casi di adozione/affidamenti preadottivi internazionali, la possibilità di fruire del congedo anche per i periodi di permanenza all’estero.
