Il Consiglio di Stato (sez. V, 14 dicembre 2021, n. 8331) è tornato sulla natura giuridica dei Consorzi Stabili, individuando nella “comune struttura di impresa”, richiesta dal codice dei contratti pubblici, l’elemento qualificante e distintivo di tale tipologia di consorzi, rispetto a quelli ordinari (vedi anche art 45, comma 2, lett. “c” ed “e”, del d.lgs. n. 50/2016).
