Anche prima della riformulazione dell’art. 105 del Codice dei contratti, doveva essere disapplicato il tetto massimo del 30% per il subappalto delle categorie “super specialistiche”, perché connotato di astrattezza e genericità (cfr. D.Lgs. n. 50/2016, come modificato dal D.L. n. 77/2021, convertito con modificazioni dalla L. n. 108/2021).
