Il criterio dell’ordine cronologico di arrivo delle manifestazioni di interesse, utilizzato per formare una graduatoria da cui selezionare gli operatori economici da invitare alle procedure negoziate sotto-soglia Ue, viene equiparato all’estrazione a sorte e quindi soggetto allo stesso generale divieto di quest’ultimo criterio.
Lo ha stabilito l’ANAC con un Parere in funzione consultiva n. 11 del 28 febbraio 2024,
