Il Supporto Giuridico del Ministero delle Infrastrutture e dei Trasporti, con il Parere n. 2582 del 17/04/2024, ha chiarito l’ambito di applicazione dell’istituto dell’avvalimento da parte del subappaltatore, ai sensi del nuovo Codice dei contratti (d.lgs. 36/2023 art. 104, comma 1).
