La mancanza del collaudo e di una consegna formale dell`opera non impediscono il decorso del termine di prescrizione (2 anni) per far valere in giudizio la responsabilità dell`appaltatore per le difformità e i vizi dell`opera ai sensi dell`art. 1667 del Codice Civile, essendo sufficiente a questo scopo che il committente abbia tenuto un comportamento “concludente”” ossia dal quale risulti la volontà di accettare l`opera.
è quanto ha stabilito la Corte di Cassazione (sez. II civile, sentenza 28 novembre 2006, n. 25227) in relazione ad una fattispecie nella quale il committente, pur non avendo effettuato il collaudo e accettato formalmente l`opera, aveva chiesto ed ottenuto il certificato di agibilità dell`immobile, iniziando ad abitare lo stesso senza contestarne la corretta esecuzione e mantenendo questo atteggiamento per diversi anni.
Pertanto, in assenza di prove circa il riconoscimento delle difformità o dei vizi da parte dell`impresa appaltatrice, il tempo decorso dalla consegna ha determinato la decadenza della possibilità sia di effettuare la denuncia di cui all`art. 1667, comma 2, che di presentare l`azione di responsabilità di cui al successivo comma 3.
