L’Ispettorato Nazionale del Lavoro, con l’allegata nota n. 5066/19, ha fornito importanti chiarimenti in ordine agli effetti della diffida accertativa di cui all’art. 12 del D.Lgs. n.124/ 04 nelle ipotesi in cui, successivamente all’emanazione della diffida medesima, ma prima della sua validazione, ovvero successivamente a questa, venga sottoscritto un verbale di conciliazione nelle forme diverse dalla conciliazione monocratica.
In particolare l’INL, richiamando la circolare n. 24/04 del Ministero del Lavoro, ha ricordato che la conciliazione sulle retribuzioni, intervenuta in sede sindacale o nelle forme della risoluzione arbitrale, non ha riflessi sull’imponibile contributivo e che quest’ultimo dovrà essere calcolato secondo quanto accertato dall’organo ispettivo.
Per quanto sopra, eventuali accordi conciliativi diversi da quello previsto dall’art 12, co. 2 del D.Lgs. n.124/ 04, intervenuti prima o in una fase successiva alla validazione della diffida accertativa, non hanno rilievo e possono essere fatti valere esclusivamente in sede giudiziale.
