Deve essere devoluta al giudice amministrativo la giurisdizione sulla legittimità del provvedimento con cui l’amministrazione ha negato l’autorizzazione al subappalto, per aver riscontrato l’insussistenza delle condizioni necessarie a rilasciarla.
