L’indicazione, da parte di un Consorzio stabile, di una consorziata per l’esecuzione di lavori del tutto carente di qualificazione SOA, comporta l’esclusione del Consorzio dalla gara, anche se la qualificazione è posseduta in proprio dallo stesso Consorzio.
È quanto deciso dall’ANAC nell’adunanza del 18 ottobre 2023, con delibera n. 470, a seguito di una istanza di parere per la soluzione delle controversie ex articolo 211, comma 1, del d.lgs. 50/2016,
