Negli appalti pubblici, tra gli elementi posti a tutela della partecipazione dell’operatore economico, costituisce un imperativo categorico e non derogabile l’obbligo della stazione appaltante di applicare il principio del contraddittorio prima di procedere all’esclusione di un’impresa dalla gara in presenza di un’offerta giudicata anomala dalla stessa amministrazione.
